From the experience of hundreds of transactions brokered by HighLife Estate, the most costly mistakes rarely come from the price paid, but from legal details overlooked. Here are the essential steps we recommend.
1. The land registry extract — the starting point

The first document you request is the informational land registry extract, issued by the Cadastre Office. It tells you who the actual owner is, what surface area is registered for the property, and — most importantly — whether there are encumbrances: mortgages, seizures, transfer restrictions, or recorded litigation.
For premium properties, attention to detail matters even more: a recently renovated villa may have unregistered constructions, and an apartment in an interwar building on Calea Victoriei may have surface areas that do not match the official records. We always recommend an updated extract, not one that is several months old.
2. Verifying the owner and the chain of title
Does the seller actually have the right to sell? It sounds like a simple question, but the chain of title — the history of transfers from one owner to the next — can hide surprises. Unresolved inheritances, revocable donations, or incomplete estate divisions tend to surface after signing.
- Check the seller's title deed (sale, inheritance, donation).
- In the case of inheritances, make sure all heirs have agreed to the sale.

Check whether a completion certificate exists for the works and whether the declared use of the building matches reality. For land plots, the urban planning certificate matters: what can be built, what density coefficients are allowed, and whether any easements exist.
4. Debts, taxes, and the certificates that must not be missing

Before signing, request the tax certificate issued by the local tax authority, confirming that property taxes are paid up to date. For an apartment, also ask for a certificate from the homeowners' association confirming there are no outstanding maintenance fees — a small detail that can otherwise transfer debts to the new owner.

- Certificate from the homeowners' association regarding maintenance fees and the repair fund.
- Proof of utility payments to avoid unpleasant surprises.

5. The role of the notary and the preliminary contract
The public notary guarantees the legality of the transaction: they verify the identity of the parties, check the encumbrances recorded in the land registry at the time of authentication, and draft the deed. However, their role does not replace prior due diligence — a notary confirms the situation as of the signing day, not the full history of the property.
The preliminary contract (the bilateral sale-purchase promise) is the moment when you secure the transaction. This is where the deposit, deadlines, suspensive conditions, and penalties are established. We recommend clear clauses: what happens if financing is not approved, what happens if hidden encumbrances appear. A well-drafted preliminary contract protects your deposit and covers you in unforeseen situations.
